Welcome to The Tasting List ("TTL," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website, mobile app, and related services (collectively, the "Service"). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, please discontinue use of the Service.
1. Overview
The Tasting List is a restaurant discovery and recommendation platform that helps users explore top-quality and trending restaurants. We're an early-stage project operated by a small team. While we strive to provide a reliable and enjoyable experience, the Service is provided "as available" and may evolve over time, including these features:
• Curated restaurant recommendations
• Restaurant discovery tools and search functionality
• Personal dining database and list management
• Reviews and information from reliable publications
For users located in the United Kingdom or European Economic Area ("EEA"), TTL acts as the 'data controller' for personal data collected through the Service, as described in our Privacy Policy.
2. Account Registration
Some features require an account. By creating one, you agree to:
• Provide accurate and current information;
• Maintain the confidentiality of your credentials;
• Accept responsibility for all activity under your account; and
• Notify us immediately of any unauthorized use.
You may delete your account at any time via in-app settings.
If you reside in the UK or EEA, you must be at least 16 years old to register for an account.
3. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
• Attempt to hack, disrupt, or interfere with the Service or its security features;
• Use bots, scrapers, or automated tools to extract data;
• Post or transmit any false, misleading, or defamatory content;
• Infringe intellectual property or privacy rights of others; or
• Use the Service in violation of any laws or regulations.
We may suspend or remove accounts that violate these rules.
4. Subscriptions and Payments
Paid features of the Service are offered through the Apple App Store (for iOS users) and the Google Play Store (for Android users). When you subscribe, your payment and billing relationship are directly with Apple or Google, not TTL.
• Billing: Charges appear on your Apple or Google account. TTL does not collect or store your payment details.
• Renewals: Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period, according to the rules of the respective store.
• Cancellations: To cancel or modify a subscription, go to your device settings:
• iOS: Settings → Apple ID → Subscriptions
• Android: Google Play → Payments & Subscriptions → Subscriptions
• Refunds: TTL cannot process refunds for purchases made through Apple or Google. Any refund requests must be submitted directly to the store provider.
• Pricing Changes: We may propose price changes, but Apple or Google will notify you and handle consent and renewals in accordance with their own terms.
• Free Trials: A free trial may be offered with limited features; continuing past the trial period converts to a paid subscription through the app store platform.
For UK and EEA consumers, you retain rights under the UK Consumer Contracts Regulations 2013 and the EU Consumer Rights Directive. You may withdraw from a digital content purchase within 14 days of confirmation unless you have already accessed or downloaded the Service during that time. Any refund or withdrawal requests must be made through Apple or Google.
5. Content and Information
Restaurant listings, details, and recommendations are provided for informational purposes only. We make reasonable efforts to ensure accuracy but cannot guarantee that all information (including menus, prices, or hours) is complete, correct, or up-to-date. Always confirm details directly with the restaurant.
Nothing in this section limits your mandatory consumer rights under applicable local law.
6. Reviewer and Community Content
Only approved reviewers may post reviews or recommendations. By submitting content, you grant TTL a non-exclusive, royalty-free, worldwide license to display, distribute, and promote that content within the Service. You are responsible for ensuring your submissions are accurate, lawful, and do not infringe others' rights. TTL may edit or remove content at its discretion.
If you are located in the UK or EEA and submit reviews or other content, you agree not to post material that is unlawful, defamatory, or misleading. TTL may moderate or remove such content in accordance with applicable consumer protection and platform transparency regulations.
7. Third-Party Services
The Service may link to or integrate with third-party websites or tools (for example, reservation platforms or maps). TTL is not responsible for the content, accuracy, or privacy practices of these third parties. Your interactions with them are governed by their own terms and policies.
8. Intellectual Property
The Tasting List Service, including its trademarks, logos, original content, features, and functionality, are owned by TTL or its licensors and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service except for your personal, non-commercial use.
9. Disclaimers
The Service is provided "as is" and "as available." We make no warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. While we aim for reliability, we cannot guarantee that the Service will be uninterrupted or error-free.
Some jurisdictions, including the UK and EEA, do not allow certain warranty exclusions. In such cases, these exclusions apply only to the extent permitted by law, and your statutory rights remain unaffected.
10. Limitation of Liability
To the fullest extent permitted by law, TTL and its team will not be liable for indirect, incidental, special, consequential, or punitive damages.
For UK and EEA consumers, we do not exclude or limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under mandatory law. TTL is not responsible for billing, payment processing, or refund actions managed by Apple or Google.
11. Termination
You may stop using the Service at any time. TTL may suspend or terminate access (with or without notice) if we reasonably believe you have violated these Terms, misused the Service, or acted unlawfully. Termination does not affect any rights or obligations that arose before it.
If you are a UK or EEA consumer, we will provide reasonable notice before closing your account, except in cases of serious misconduct or legal necessity.
12. Changes to These Terms
We may update or modify these Terms occasionally. If we make material changes, we will notify you via email or in-app notice. Continuing to use the Service after updates take effect means you accept the revised Terms.
For UK and EEA users, material changes that affect your rights will be notified at least 30 days before taking effect, unless required sooner by law.
13. Governing Law and Jurisdiction (U.S. & International Users)
These Terms and any disputes arising under them are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
If you reside in the UK or EEA, you also benefit from the mandatory consumer protection laws of your country of residence, and you may bring disputes before your local courts. Nothing in these Terms limits these rights.
If you access the Service from outside the U.S., you do so at your own risk and are responsible for compliance with local laws.
